Terms of use
These terms
These terms apply when you read this website. By using it, you accept them. If you do not accept them, the site is still readable, but you should not rely on it for anything beyond a first impression.
They do not govern a project. Work we do for a client is governed by a separate written agreement, signed by both sides, which sets out scope, timing, payment and ownership. Where that agreement and these terms differ, the agreement wins.
What this site is
This website describes a software development and sales company and the kind of work it takes on. It is information, not an offer. Nothing on it — a description of a service, an example of an engagement, a sentence about how we work — creates a contract, a warranty, or a commitment to deliver anything.
Descriptions are written to be accurate at the time of publication, but a short page cannot capture the detail of a real project. If you need to know whether we can do something specific, ask us. A written answer to a written question is worth more than anything a marketing page can promise.
Using the site
You may read the site, print a page for your own reference, and share a link with someone who might find it useful. You may not:
- Copy substantial parts of the site and present them as your own.
- Remove an attribution or credit from an image or a quotation.
- Use the site to distribute malware, scrape it at a volume that degrades service, or probe it for weaknesses without permission.
- Frame the site inside another product in a way that suggests we endorse it.
- Use our name or marks in a way that implies a partnership that does not exist.
If you find a security problem, tell us before you tell anyone else. We will acknowledge it, fix it, and credit you if you would like to be credited.
Content and ownership
The text, layout, code and original graphics on this site belong to Mirai Apps. The paintings reproduced on the homepage are in the public domain; the photographs are used under the licence of the service that supplied them. Credits are listed on the corporate page.
You keep everything you send us. Sending a message or a document does not transfer ownership of it, and it does not give us the right to publish it. If we would like to refer to your project publicly, we will ask first.
Links to other places
The site links to a Discord server and, occasionally, to material elsewhere. Those places are not under our control. We do not endorse everything said in a community server, and we are not responsible for another site's content, availability or privacy practices. Follow a link at your own discretion.
Enquiries
Sending an enquiry does not create a client relationship. It starts a conversation. We may decline work, and we often do when we are not the right team for it; in that case we will say so and, where we can, suggest what we would do instead.
Please do not send confidential material before an agreement is in place. If a conversation needs a confidentiality agreement first, say so and we will arrange one.
Availability
We keep the site online and patched, but we do not promise that it will be available at every moment. Maintenance, a supplier outage, or a network fault can interrupt it. Nothing on the site is an emergency service, and it should not be relied on as one.
Limits of liability
To the extent the law allows, Mirai Apps is not liable for indirect or consequential loss arising from your use of this website, including lost profit, lost data, or lost opportunity. Where liability cannot be excluded, it is limited to the amount you paid to use the site, which is nothing.
Nothing in these terms excludes liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded.
Changes
We may revise these terms as the site changes. The version published here is the version that applies. The date at the top of the page is the date of the most recent revision, and a material change will be described rather than hidden.
Governing law
These terms are governed by the law that applies to Mirai Apps where it is established. If a dispute arises from reading this website, we will try to resolve it in conversation first, because that is cheaper and faster for everyone involved.
